Welcome to Heyomi. By accessing or using our AI-powered content creation platform, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.
1. Acceptance of Terms
By accessing and using Heyomi's services, including our AI-powered video, image, music, and voiceover generation tools, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, you should not use our services.
2. Use of Service
Heyomi provides AI-powered tools for creating videos, images, music, and voiceovers. You agree to use our services only for lawful purposes and in accordance with these Terms. You are prohibited from using our services:
- To create content that violates any applicable national or international law or regulation
- To generate harmful, illegal, defamatory, or infringing content
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
- To create deepfakes or misleading content without proper disclosure
- To infringe upon copyrights, trademarks, or other intellectual property rights
3. User Accounts and Gems
When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. You are responsible for maintaining the confidentiality of your account and password.
Heyomi operates on a gem-based system. Gems are purchased credits used to generate content. Gems never expire and are non-refundable once purchased, except as outlined in our Refund Policy below.
4. Content Ownership and Rights
You retain full ownership of content you create using Heyomi. You have the right to use, distribute, and commercialize your generated content for any lawful purpose, including social media, YouTube, commercial projects, and more.
However, you are solely responsible for ensuring your use of the content complies with applicable laws and does not infringe on third-party rights. Heyomi is not liable for how you choose to use generated content.
5. Intellectual Property
The Heyomi platform, including its original features, functionality, and underlying AI technology, remains the exclusive property of Heyomi and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
5. Limitation of Liability
In no event shall Heyomi, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Any unused gems will be forfeited upon account termination for Terms violations.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
Refund Policy
We want you to be satisfied with Heyomi. This Refund Policy outlines the conditions under which refunds are available for gem purchases and generated content.
1. Gem Purchases
Heyomi operates on a pay-as-you-go gem system. Gems are purchased credits that never expire. Please note:
- Gems never expire and remain in your account indefinitely
- There are no monthly subscriptions or recurring charges
- You only pay for what you use
- Unused gems are generally non-refundable, except within our 14-day guarantee period
2. 14-Day Money-Back Guarantee
For first-time gem purchases, we offer a 14-day money-back guarantee. If you are not satisfied with Heyomi within the first 14 days of your initial gem purchase, you may request a full refund for unused gems. This guarantee applies only to your first gem purchase and does not apply to:
- Subsequent gem purchases
- Gems that have already been used to generate content
- Accounts that have violated our Terms of Service
- Requests made after extensive platform usage
3. How to Request a Refund
To request a refund under our 14-day money-back guarantee, please contact our customer support team at support@heyomi.video with the following information:
- Your account email address
- Your gem purchase order number
- The reason for your refund request
Refund requests must be submitted within 14 days of your initial purchase date. We will process approved refunds within 5-10 business days.
4. Failed Generations
If a content generation fails due to technical issues on our end, the gems used will be automatically refunded to your account. If you believe gems were incorrectly deducted, please contact support@heyomi.video immediately.
5. Technical Issues
If you experience technical issues that prevent you from using Heyomi, please contact our support team at support@heyomi.video immediately. We will work to resolve the issue promptly. In cases where we cannot resolve technical issues within a reasonable timeframe, we may offer gem credits at our discretion.
6. Prohibited Refund Circumstances
Refunds will not be provided in the following circumstances:
- Account termination due to violation of Terms of Service
- Dissatisfaction with AI-generated content quality (AI results may vary)
- Change of mind after the 14-day guarantee period
- External factors beyond our control (e.g., internet connectivity issues)
- Gems that have already been used for successful content generation
- User error in prompt creation or content specifications
7. Refund Processing
Approved refunds will be processed using the original payment method. Please allow 5-10 business days for the refund to appear in your account, depending on your financial institution's processing time.
8. Changes to Refund Policy
We reserve the right to modify this Refund Policy at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after any changes constitutes acceptance of the new Refund Policy.
